Last month a federal judge in Boston issued a landmark ruling in Orr v. Trump, striking down the Trump administration’s discriminatory policy that forced U.S. passports to reflect only the sex assigned at birth on US passports.

This remarkable court injunction, expanded to cover ALL trans, nonbinary, and intersex passport holders, allows you to self-select your gender marker—male (M), female (F), or X—WITHOUT needing a corrected birth certificate.

The ACLU is celebrating this critical victory against discrimination but warns that the fight is far from over.

The Trump admin’s January 2025 executive order tried to ban X markers and gender changes on passports, and ongoing legal challenges could reverse this progress. That’s why the ACLU is urging everyone who needs an updated passport to act NOW!

Apply or renew your passport ASAP to secure a gender marker that reflects your true identity.

Key ACLU Guidance:

* Apply Immediately: The State Department is complying with the court order, and some folks have received accurate passports. This is much more successful than the delays experienced earlier this year—prior to the court order.

* Fix Errors: Did you obtain a passport in 2025 with the wrong gender marker? Use Form DS-5504 to request a free correction. The State Department must comply.

* Urgent Travel Needs? Visit a passport office in person—some applicants have successfully updated their passports this way.

* Stay Cautious: The ACLU’s detailed FAQ advises caution until the State Department fully clarifies compliance. Check their website or the State Department’s updated guidance for the latest.

The ACLU calls the latest Trump policies discriminatory and unconstitutional, violating the rights of trans, nonbinary, and intersex individuals. They’re pushing for sustained legal and public pressure to ensure equitable access to accurate IDs and passports.
