BREAKING: The American Civil Liberties Union says it is suing the state of Idaho over a newly enacted law restricting restroom access for transgender people.

The organization announced the lawsuit, stating:
“We’re suing Idaho over a new state law banning transgender people from using the correct restrooms in all government-owned buildings and private businesses that are open to the public. This extreme law threatens felony convictions and up to 5 years in prison.”

The law, known as House Bill 752, was passed by Idaho’s legislature and signed by the governor in 2026, and applies to public buildings and businesses open to the public. It makes it a crime to use a restroom that does not align with a person’s sex assigned at birth, with penalties that can escalate to a felony charge carrying up to five years in prison.

The legal challenge has now been formally announced. In its filing, the ACLU is expected to argue the law violates constitutional protections, including equal protection and due process, as well as federal civil rights law. Legal challenges to similar measures in other states have produced mixed results, but courts have increasingly scrutinized policies that single out transgender individuals for different treatment.
